Netnaija CEO Remanded in Prison Over Alleged Copyright Violations

Emmanuel Analike, CEO of Netnaija Media Enterprises, has been remanded in Kuje Correctional Centre following his arraignment on charges of copyright infringement. The case was brought by the Nigerian Copyright Commission (NCC).

Analike faces allegations related to the possession, reproduction, and distribution of copyrighted works without authorization. These reportedly include sound recordings and audiovisual content from both local and international creators.

At the Federal High Court in Abuja, Justice Suleiman Liman ordered that Analike remain in custody pending the determination of his bail application, which is scheduled for March 9. His lawyer, Nnemeka Ejiofor, informed the court that the bail petition had been filed on Monday, supported by 23 paragraphs of affidavits and a written address. However, the judge deferred ruling on the application until the set date.

The prosecution, led by Gladys Isaac-Ojo, Head of Legal at NCC, stated that Analike’s alleged actions contravene Section 44 (1)(a) of the Copyright Act, 2022. During the proceedings, Analike pleaded not guilty to the charges.

Speaking to journalists after the hearing, Isaac-Ojo emphasized that Analike’s arrest followed sustained investigations into online piracy involving Netnaija’s platform, which hosts movies and music for download. She described the arraignment as a significant achievement for the NCC, noting that while the case is just beginning, bringing the matter to court marks an important step in the fight against copyright infringement.

“The defendant has the legal right to seek bail, and it will be up to the court to decide. Our role is to ensure the law is upheld,” she said.

The NCC stressed that both Analike and his company could be held accountable under the law for copyright violations.

The court is expected to rule on the bail application on March 9, after which the trial will proceed.
